JEREMY WILLIAMS, Appellant
V.
THE STATE OF TEXAS, Appellee
.............................................................
On Appeal from the 283rd Judicial District Court
Dallas County, Texas
Trial Court Cause No. F96-01920
.............................................................
MEMORANDUM OPINION
Before Justices Wright, Bridges, and Mazzant
Jeremy Williams was convicted of the capital murder of his infant son and sentenced to life imprisonment. The trial court's judgment was affirmed on direct appeal. Williams v. State, No. 05- 97-00206-CR (Tex. App.-Dallas , Dec. 31, 1998, pet. ref'd) (not designated for publication). On June 4, 2008, appellant filed a motion for an out-of-time new trial, which was denied. He now appeals the denial of the order denying the motion. An order denying a motion for an out-of-time new trial is not an appealable order. See generally Ex parte Apolinar, 820 S.W.2d 792, 794 (Tex. Crim. App. 1991); Wright v. State, 969 S.W.2d 588, 589 (Tex. App.-Dallas 1998, no pet.).
We dismiss the appeal for want of jurisdiction.
