TROY JOE COX, Appellant
V.
THE STATE OF TEXAS, Appellee
.............................................................
On Appeal from the 380th Judicial District Court
Collin County, Texas
Trial Court Cause No. 380-80606-04
.............................................................
MEMORANDUM OPINION
Before Justices O'Neill, Richter, and Lang
Troy Joe Cox was convicted of possession of methamphetamine in an amount less than one gram. On October 14, 2004, punishment was assessed at two years' imprisonment in a state jail facility, probated for five years. Appellant appealed, and the trial court's judgment was affirmed.  See Cox v. State, No. 05-04-01657-CR (Tex. App.-Dallas Feb. 28, 2006, no pet.) (not designated for publication).
On August 31, 2007, appellant filed a notice of “out-of-time” appeal, again seeking to appeal the trial court's October 14, 2004 judgment. Appellant's August 31, 2007 notice of appeal is untimely as to the October 14, 2004 judgment. See Tex. R. App. P. 26.2; Slaton v. State, 981 S.W.2d 208, 210 (Tex. Crim. App. 1998) (per curiam); Boyd v. State, 971 S.W.2d 603, 605-06 (Tex. App.-Dallas 1998, no pet.). Moreover, appellant's notice of appeal does not indicate appellant is challenging any new order or judgment of the trial court. Accordingly, we dismiss the appeal for want of jurisdiction.
