V.
WELBORNE'S APPLIANCES, Appellee
.................................................................
On Appeal from the 44th District Court
Dallas County, Texas
Trial Court Cause No. 84-4591-B
.................................................................
O P I N I O N
Before Chief Justice Enoch and Justices Whitham and Ovard
Opinion By Justice Ovard
Dominga and Baldemar Rios appeal from a summary judgment for Welborne's Appliances in a suit alleging breach of warranty and negligence. At oral argument, Welborne's Appliances conceded that the negligence issue of the trial court's judgment should be reversed and remanded for new trial. Accordingly, we reverse the trial court's judgment and remand the cause for new trial.
In view of our disposition of this appeal, we do not address other issues before the trial court on motion for summary judgment.
The judgment is reversed and remanded.
