In the Matter of the Reinstatement of Michael Christopher Radmilovich to Membership in the Oklahoma Bar Association and to the Roll of Attorneys.

ORDER

The petitioner, Michael Christopher Radmilovich (Radmilovich/attorney) was stricken from the roll of attorneys from the Oklahoma Bar Association on July 7, 1998, after he untimely filed a Mandatory Continuing Legal Education Report of Compliance without the $50.00 late fee. Petitioner was licensed and practiced law in Nevada since October of 1990. On April 19, 2013, he petitioned this Court for reinstatement as a member of the Oklahoma Bar Association.

On July 16, 2013, a hearing was held before the Trial Panel of the Professional Responsibility Tribunal and the tribunal recommended that the attorney be reinstated. Upon consideration of the matter, we find:

1) The attorney has met all the procedural requirements necessary for reinstatement in the Oklahoma Bar Association as set out in Rule 11, Rules Governing Disciplinary Proceedings, 5 O.S. 2011, ch.1, app. 1-A.

2) The attorney has established by clear and convincing evidence that he has not engaged in the unauthorized practice of law in the State of Oklahoma.

3) The attorney has established by clear and convincing evidence that he possesses the competency and learning in the law required for reinstatement to the Oklahoma Bar Association.

4) The attorney has established by clear and convincing evidence that he possesses the good moral character which would entitle him to be reinstated to the Oklahoma Bar Association.

5) The attorney has established by clear and convincing evidence that he has already completed the required mandatory continuing education requirements for 2013.

6) The transcript provided was reduced to 4 transcript pages on each side of one 8 ½ by 11 sheet and the invoice for the transcript exceeds the statutory limits of $3.50 a page allowed to court reporters. This Court has not authorized any transcripts which do not fall within the strictures allowed by authorized court reporter. 20 O.S. 2011 §106.4(b).

IT IS THEREFORE ORDERED that the petition of Michael Christopher Radmilovich for reinstatement be granted. The costs associated with these proceedings should not include the cost for transcripts which are not authorized within the limits applicable to court reporters. The amount of $945.53 of costs is reduced by $561.23 and shall be paid prior to reinstatement.

IT IS FURTHER ORDERED that the attorney pay his 2013 Bar Association dues within 30 days of the date of this order. Reinstatement is conditioned upon the attorney's payment of these dues.
