Granville Scanland, County Atty., Nathan S. Sherman, Asst. County Atty., Oklahoma City, for plaintiff in error.

Washington & Thompson, Oklahoma City, for defendant in error.

O'NEAL, J.

¶1 On December 1, 1953, the order over-ruling the motion for new trial was entered. Time in which to appeal expired thereafter on March 1, 1954. No order was entered by the trial court extending this time. The case-made was filed April 12, 1954.
