The judgment of the trial court in this cause is reversed and the cause remanded for a new trial on account of failure of defendant in error to file brief.

Appeal from District Court, Logan County; Charles C. Smith, Judge.

Action by R. S. Savery against William H. Shelby and others. From the judgment of the trial court in favor of the defendants, plaintiff appeals. Reversed and remanded.
