(Syllabus.)

1. Habeas Corpus-Court Will not Entertain Application for Writ Based on Grounds Existing or Presented When First Application Was Made. Where Criminal Court of Appeals has denied application for writ of habeas corpus, it will not ordinarily entertain a subsequent application for such writ on the same grounds or facts existing when the first application was made whether then presented or not.

2. Same Where Allegations of Second Petition in Habeas Corpus Same as Those in Former Application, Demurrer of Respondent Sustained and Writ Denied. Where allegations of second petition in habeas corpus are substantially the same as those considered in former application, demurrer of respondent will be sustained and writ denied.

Original proceeding in the matter of a petition by Walter Cavers for a writ of habeas corpus to secure his release from the State Penitentiary. Writ denied.

JONES, J. The petitioner, Walter Cavers, seeks his release from confinement in the State Penitentiary by this proceeding in habeas corpus.
