Per Curiam.

[¶1] William L. Dethloff appealed from a second reinstated judgment granting Sandra L. Dethloff a divorce and dividing their property. We affirm under N.D.R.App.P. 35.1(a)(2) and (4). Foreng v. Foreng, 509 N.W.2d 38 (N.D. 1993)(holding principal standards guiding award of attorney fees in a divorce action are one party's need and the other party's ability to pay). Pozarnsky v. Pozarnsky, 494 N.W.2d 148, 151 (N.D. 1992)(holding award of attorney fees under section 14-05-23, N.D.C.C., does not depend entirely on merit of each position although one party's actions escalating fees unreasonably can be a factor).
