Kerzmann v. Burleigh County Social Services20050076CA

Per Curiam.

[¶1] Corinne Kerzmann appealed from an order of the district court dismissing her attempted appeal from the decision of an administrative law judge affirming her termination as an employee with Burleigh County Social Services, on the ground the district court did not have subject-matter jurisdiction because Kerzmann failed to properly perfect her appeal under N.D.C.C. § 28-32-42.

[¶2] The order dismissing the appeal is affirmed under N.D.R.App.P. 35.1(a)(7), in accordance with the controlling dispositive appellate decisions of DuPaul v. North Dakota Dep't of Transp., 2003 ND 201, ¶¶ 6-10, 672 N.W.2d 680 and Benson v. Workforce Safety & Ins., 2003 ND 193, ¶¶ 5-7, 672 N.W.2d 640.
