The opposition submitted by Defendants Springs Fireplace Properties, LLC and Michael Dubin is deficient since both Defendants are in default in appearing in this action and have not moved to vacate their default. As such, any non-jurisdictional defenses cannot be raised (see Deutsche Bank Natl. Trust Co. v Hall, 185 AD3d 1006 [2d Dept 2020]). In any event, Defendants' claim that this matter is stayed by the Executive Orders issued by Governor Andrew Cuomo is without merit as EO §202.28 no longer applies to residential real property (see EO §202.48). Likewise, the subsequently enacted COVID-19 Emergency Eviction and Foreclosure and Prevention Act of 2020 (L. 2020, c.381) is inapplicable as neither the owner nor the mortgagor or'the premises is a "natural person".
