Appeal from an order of the Civil Court of the City of New York, Queens County (James E. d'Auguste, J.), entered August 7, 2012. The order, insofar as appealed from, granted defendant's motion for summary judgment dismissing the complaint.

ORDERED that the order, insofar as appealed from, is affirmed, with $25 costs.

For the reasons stated in Flatbush Chiropractic, P.C. as Assignee of Gerard Edouard Riboul v Omni Indem. Co. (___ Misc 3d ___, 2014 NY Slip Op ___ [Appeal No. 2012-2088 Q C ], decided herewith), the order, insofar as appealed from, is affirmed.
