People v Brower 2007 NY Slip Op 10167 [46 AD3d 833] December 18, 2007 Appellate Division, Second Department Published by New York State Law Reporting Bureau pursuant to Judiciary Law § 431. As corrected through Wednesday, February 13, 2008

The People of the State of New York, Respondent,
v
Paul Brower, Appellant.

—[*1] Mitchell Dranow, Mineola, N.Y., for appellant.

Kathleen M. Rice, District Attorney, Mineola, N.Y. (Tammy J. Smiley of counsel; Adam Buchwalter on the brief), for respondent.

Appeal by the defendant from a judgment of the County Court, Nassau County (Donnino, J.), rendered August 4, 2004, convicting him of burglary in the third degree, upon his plea of guilty, and imposing sentence.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted (see Anders v California, 386 US 738 [1967]; People v Paige, 54 AD2d 631 [1976]). Crane, J.P., Rivera, Angiolillo and Dickerson, JJ., concur.
