Docket Number: a2509-13 PER CURIAM In this consolidated opinion, we review the appeals of three parents from the January 17, 2014 order terminating their parental rights. Defendant D.G. (Debby1) is the mother of all three children: S.R. (Sandra), born in 1999, whose father is defendant R.V.R. (Rich)2; S.M. (Susan), born in 2003, whose father is defendant C.A.M. (Craig) and A-B.N.G. (Andy), born in 2004, whose father is A.W.3 After a thorough review of the record, we affirm. At the time of trial, the family had a fourteen-year history with the New Jersey Division of Child Protection and Permanency (Division)4. In 1999, shortly after Sandra's birth, the Division first became involved when it was contacted with an allegation that the baby slept on a dirty mattress on the floor in a "nasty" apartment where there were rats as well as "trash everywhere." Neglect was not substantiated, but services were nonetheless provided. The case was closed in November 2000.

Docket Number: a1609-13 PER CURIAM Defendants J.T. and J.M. both appeal a judgment, entered at the conclusion of a four-day trial in October and November 2013, that terminated their parental rights to J.T., Jr., who was born on May 7, 2011. J.M., the child's mother, argues that the Division of Child Protection and Permanency (the Division) failed to prove the third prong of N.J.S.A. 30:4C-15.1(a)(3) – that the Division failed to make reasonable efforts toward reunification – and that the judge erred in preventing her from calling certain witnesses, namely, the child's paternal grandmother and grandfather. J.T., the child's father, similarly contends the Division's proofs were insufficient on the third prong; he also argues the Division failed to satisfy the fourth prong – termination of parental rights will not do more harm than good, N.J.S.A. 30:4C-15.1(a)(4). We find no merit in these arguments and affirm.

In April 2007, the court sentenced Venable to an aggregate term of life imprisonment, subject to the No Early Release Act (NERA), N.J.S.A. 2C:43-7.2, and Simmons to an aggregate forty-year term of imprisonment, subject to NERA. We affirmed the convictions and sentences in a consolidated direct appeal. State v. Venable, 411 N.J. Super. 458, 460 (App. Div.), certif. denied, 202 N.J. 347 (2010).2

Eight resident property owners (objectors) filed an answer and were granted status as intervenors. All parties appeared for oral argument.

In January 2010 Tricare sought to convert leased property,1 the Parrott Mill Inn, a bed and breakfast in Chatham, to a residential rehabilitation center for compulsive gamblers. Tricare maintained that the conversion merely continued a nonconforming use of the property. When the Zoning Board did not agree, Tricare filed a complaint in lieu of prerogative writs on May 13, 2010.

The Mercer County Improvement Authority solicited bids in 2012 for a solid waste services contract. The Authority received three bids, each of which it rejected as non-conforming. The low bidder, Republic Services of New Jersey, L.L.C., and the next lowest bidder, Waste Management of New Jersey, Inc., filed separate suits challenging the rejection of their bids. The Law Division affirmed the Authority's rejection of both bids and dismissed the complaints with prejudice. We heard argument on the bidders' appeals of those final orders back-to-back and we now address both in this opinion. We affirm the rejection of Waste Management's bid but reverse rejection of Republic's for the reasons that follow.

In these appeals, defendant M.R. asks us to reverse a judgment of conviction of two counts of sexual assault and one count each of criminal sexual contact and simple assault, crimes he committed against his wife, for which he was sentenced to an aggregate five-year prison term and ordered to comply with the registration and reporting requirements of Megan's Law. Defendant argues that his trial was plagued by errors that occurred at nearly every phase: during jury selection, because the case was tried on the anniversary of the September 11 attacks and his trial counsel did not adequately question prospective jurors about possible prejudice; throughout the State's case, due to the prosecutor making unduly prejudicial remarks in his opening and closing statements, conducting an improper examination of the victim, and withholding exculpatory evidence; during the victim's testimony, when she referred to her domestic violence case and during a nurse's testimony, when she gave improper expert testimony; and during jury deliberations, because the court waited until after the jurors returned a verdict before granting defendant's motion to dismiss a kidnapping charge.

In his appeal, Martin contends only that the judge "failed to properly consider[] alternatives to termination" of his parental rights, specifically by not ordering placement of the two youngest children with their paternal grandparents. We find no merit in these arguments and affirm.

Docket Number: a5587-12 NUGENT, J.A.D. Plaintiff Poroshat Shakoor and defendant Khashayar Mohammadi are the divorced mother and father of two special needs children, a son and a daughter. Although the parties are devoted to their children, approximately two years after their divorce they became embroiled in a dispute over the extent to which plaintiff is required to inform defendant about the children's medical and therapeutic regimes, and the extent to which defendant could involve himself in the children's schooling and medical care. The dispute has spawned contentious motion practice, resulting in the seven orders which defendant challenges in these consolidated appeals. The issues defendant raises are fact-sensitive and their resolution requires the expertise that has been developed by Family Part judges, to whom we generally defer when their findings and conclusions are supported by competent, credible evidence. Having considered defendant's arguments in light of the record and controlling law, we conclude that with the exception of the allocation of a parenting coordinator's fees, the decisions underlying the orders are supported by competent, credible evidence. Accordingly, we affirm in part, reverse in part, and remand for the trial court to resolve the issue of allocation of the parenting coordinator's fees.

Docket Number: a2151-12 PER CURIAM In these consolidated appeals defendant Martin Luther Baskerville seeks to collaterally attack a 1993 conviction arising from a 1988 indictment returned by a Bergen County Grand Jury that charged him with first degree armed robbery, N.J.S.A. 2C:15-1, fourth degree aggravated assault, N.J.S.A. 2C:12-1(b)(5), and fourth degree resisting arrest by eluding a police officer, N.J.S.A. 2C:29-2. Defendant was tried before a jury and convicted on July 1, 1993 of all three of these charges. The trial court sentenced defendant to a term of twenty years on the armed robbery count, and a term of eighteen months for each of the aggravated assault and resisting arrest counts, to run concurrently with the twenty-year term. The resultant twenty-year sentence was to run consecutively with a sentence defendant was serving in New York State.

Docket Number: a2151-12 PER CURIAM In these consolidated appeals defendant Martin Luther Baskerville seeks to collaterally attack a 1993 conviction arising from a 1988 indictment returned by a Bergen County Grand Jury that charged him with first degree armed robbery, N.J.S.A. 2C:15-1, fourth degree aggravated assault, N.J.S.A. 2C:12-1(b)(5), and fourth degree resisting arrest by eluding a police officer, N.J.S.A. 2C:29-2. Defendant was tried before a jury and convicted on July 1, 1993 of all three of these charges. The trial court sentenced defendant to a term of twenty years on the armed robbery count, and a term of eighteen months for each of the aggravated assault and resisting arrest counts, to run concurrently with the twenty-year term. The resultant twenty-year sentence was to run consecutively with a sentence defendant was serving in New York State.
