MEMORANDUM.
Defendant appeals as of right from a circuit court order that resentenced defendant following the
court’s decision to grant his motion for relief from judgment. This appeal is being decided without oral
argument pursuant to MCR 7.214(E).
Previously, this Court entered a peremptory order reversing the trial court’s order that granted
defendant’s motion for relief from judgment and reinstating defendant’s original sixty to ninety year
sentence (Order of the Court of Appeals, Docket No. 214241, 01/28/99). Accordingly, the present
claim of appeal—which was filed after issuance of the above order—is moot and must be dismissed.
The appeal is dismissed as moot.
