I, like Judge Talbot, concur because I am constrained to do so by the Supreme Court's
order on remand. I believe that statutory changes have substantially altered the standard of
review governing this matter, and that the employment of what I would consider to be the
formerly applicable standard of review severely limits our meaningful review of the issues
presented on appeal.
