The second sentence of paragraph 8 is revised to remove a duplicated word: . . . the Town’s decision to accept a deed of property from Ouellette in lieu of formal restitution constituted a “a bargain[ed] for exchange” that sufficiently compensated the Town. The last sentence of paragraph 16 is revised to add a comma that was omitted: Therefore, although section 2115-A(2-B) specifically authorizes the State to appeal from the trial court’s denial, in whole or in part, of its Rule 35 motion, to do so, the State must file a notice of appeal accompanied by a written approval by the Attorney General. The original decision on the Court’s website has been replaced with the opinion as revised.
