MAINE SUPREME JUDICIAL COURT Sitting as the Law Court Docket No. Cum-18-447 Decision No. 2019 ME 130 Leslie S. Fissmer et al. ORDER ON MOTION TO RECONSIDER v. David D. Smith et al. David D. Smith, Cunner Lane, LLC, and Cunner Lane II, LLC, have filed a motion to reconsider the Court’s decision dated August 8, 2019. On September 9, 2019, this Court notified the parties that it intended to add a final “bullet point” in the list within paragraph 50 and ordered that any party that wished to respond to the Court’s intended amendment do so by September 16, 2019. No party has filed any response to the intended amendment. It is ORDERED that the opinion issued on August 8, 2019, is revised by adding the following as a “bullet point” to the end of paragraph 50: • Any “additional litigation” undertaken may require the trial court to address the issue of res judicata.
