STATE OF LOUISIANA * NO. 2018-K-0233 VERSUS * COURT OF APPEAL MELVIN MIGUEL * FOURTH CIRCUIT * STATE OF LOUISIANA * * ******* MCKAY, C.J., DISSENTS WITH REASONS I respectfully dissent from the majority’s opinion in granting the rehearing and in granting the writ. On April 4, 2018, this Court denied the defendant’s writ application. Pursuant to Uniform Rule 2-18.7, and as recognized by the majority opinion, an application for rehearing of a writ denial is not permitted. Accordingly, I would deny the defendant’s application for rehearing and I would not consider the merits of the writ, as we no longer have jurisdiction in this matter.
