App. 4 Cir. 3/20/13), 119 So.3d 23, I agree with the majority in affirming the March 13, 2012 judgment granting Icehouse a new trial. However, I would find that the district court erred in its September 2, 2015 judgment dismissing Icehouse from all liability in this matter.
