CHERYL MOORE, KIM WATTINGEY AND HENRY MARTIN * NO. 2002-CA-1144 * COURT OF APPEAL VERSUS * FOURTH CIRCUIT KENILWORTH/KAILAS PROPERTIES AND COLONY INSURANCE COMPANY * STATE OF LOUISIANA * * ******* BYRNES, C.J., CONCURS WITH REASONS I agree with everything set forth in the majority opinion. I respectfully concur merely to add as an additional reason in support of the decision to reverse the fact that summary judgment is a poor vehicle for determining matters that are insusceptible of precise determination such as general damages or, as in this case, the allocation of comparative fault.
