NO. 01-1-1516) ORDER GRANTING APPELLANT JUAN VALLO S SECOND MOTION FOR DISMISSAL (By: Moon, C.J., Levinson, Nakayama and Acoba, JJ., and Circuit Judge Chan, assigned by reason of vacancy) Upon consideration of Defendant-Appellant Juan Vallo s motion for dismissal of his appeal pursuant to HRAP Rule 42(c), the papers in support, and the records and files herein, it appears that Appellant states: (1) he understands he has a right to appeal; (2) he understands the consequences of dismissing his appeal and he is waiving his right to appeal; and (3) he believes it is in his best interest to dismiss his appeal and participate in the sex offender treatment program.
