MEMORANDUM OPINION George Lee Jones, a Virginia inmate proceeding pro se and informa pauperis, brings this action pursuant to 42 U.S.C. § 1983.' Jones alleges that Defendant Dr. Inder Jeet Singh Gujral ("Defendant Gujral"), a physician at Sussex II State Prison, was deliberately indifferent to his medical needs in violation of the Eighth Amendment.^ (Compl. 4, ECF No. 1.)^ By Memorandum Order entered on September 5, 2017, the Court denied without prejudice Defendant's Motion for Summary Judgment. (ECF No. 31.) The matter is now before the Court on the Defendant's Second Motion for Summary Judgment. ("Motion for Summary Judgment," 'The statute provides, in pertinent part: Every person who, under color ofany statute ... of any State ... subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law.... 42U.S.C. § 1983. ^ "Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted." U.S. Const, amend. VIII. ^ The Court employs the pagination assigned by the CM/ECF docketing system for citations to Jones's submissions.
