VA Plaintiff, v. Civil Action No. 3:15CV709 DEPUTY McCLAIN, Defendant. MEMORANDUM OPINION By Memorandum Order entered on December 22, 2015, the Court conditionally docketed Plaintiffs action. At that time, the Court warned Plaintiff that he must keep the Court infonned as to his current address in the event that he relocated. On October 6, 2016, the United States Postal Service returned a September 27, 2016 Memorandum Order to the Court marked, "RETURN TO SENDER," "ATTEMPTED-NOT KNOWN," AND "UNABLE TO FORWARD," because Plaintiff apparently relocated. Since that date, Plaintiff has not contacted the Court to provide a current address. Plaintiffs failure to contact the Court and provide a current address indicates his lack of interest in prosecuting this action. See Fed. R. Civ. P. 41 (b). Accordingly, the action will be DISMISSED WITHOUT PREJUDICE. An appropriate Order shall accompany this Memorandum Opinion. 181 DEC 0 2 20Jl M L/' Jf' M.
