If Plaintiff elects to file such a motion, it shall be filed within 21 days of the date of entry of this Order and shall be accompanied by a supporting brief that includes as an exhibit Plaintiff's proposed amended complaint. Plaintiff Alynna Edouard ('"Plaintiff") asserts claims under the Americans with Disabilities Act of 1990 (the "ADA"), Title VII of the Civil Rights Act of 1964 ("Title VII"), and 42 U.S.C. § 1981 ("§ 1981") against defendant John S. Connor, Inc., ("Defendant"). Defendant moves to dismiss Plaintiff's complaint (the "Complaint") for failure to state a claim pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure. ECF Nos. 11, 12. After examining the briefs and the record, the Court DENIES Defendant's request for a hearing, ECF No. 15, because the facts and legal contentions are adequately- presented, and oral argument would not aid in the decisional process.
