OPINION AND ORDER This case arises from a contractual dispute between Plaintiff Allan Myers VA, Inc. {''Myers") and Defendant Ocean Construction Services, Inc ("OCS") sections of Arlington involving National renovation Cemetery work (the performed in "Project"). Presently before the Court is Myers' motion for partial summary judgment. ECF No. 38. For the reasons stated below, the motion is DENIED. I. FACTUAL BACKGROUND AND PROCEDURAL HISTORY On June 5, 2020, DCS contracted with the United States Army Corps of Engineers ("USACE") to renovate sections of Arlington National Cemetery. Shortly thereafter, DCS and Myers entered into a subcontract (the "Subcontract") requiring Myers to perform the utility earthwork, concrete, and asphalt work for the Project.
