Court Description: MEMORANDUM OPINION AND ORDER REGARDING ATTORNEY FEES UNDER 42 U.S.C. § 406(b): For the foregoing reasons, the Court GRANTS the Petition to Obtain Approval of a Fee for Representing a Social Security Claimant (doc. 28 ) and Plaintiff's counsel is awarded $30,046.87 in attorney fees out of Plaintiff's past-due benefits pursuant to 42 U.S.C. § 406(b) and the Social Security Administration is ordered to release such amount as and for an attorney's fee to Plainti ff's counsel, Ronald D. Honig. Because the Court previously awarded counsel fees in the amount of $6,075.03 pursuant to the EAJA, counsel must refund that amount to Plaintiff as the smaller of the two fee awards.
