Court Description: Memorandum Opinion and Order: For the foregoing reasons, we find that the User Agreement's forum selection clause is valid and enforceable. Defendants motion to dismiss and/or to transfer for improper venue is granted. Under the circumstances, transfer of this case to the Northern District of Texas is preferable to dismissal without prejudice. In addition, plaintiffs' anticipated motion to amend is denied.
