Murphy v. Amarillo National Bank, No. 2:2020cv00048 - Document 19 (N.D. Tex. 2021)
Court Description: MEMORANDUM OPINION AND ORDER re granting 7 Motion to Dismiss for Failure to State a Claim. It is hereby ORDERED that Defendant's Motion to Dismiss (ECF No. 7) is GRANTED. Plaintiff's claim for breach of contract is DISMISSED without preju dice for lack of standing. Plaintiff's claims for Petition to Quiet Title, Trespass to Try Title and Slander of Title are DISMISSED with prejudice for failure to state a claim upon which relief can be granted. Furthermore, because Plaintiff has indicated by his briefing that he does not intend to amend any claims, the Court finds providing an opportunity to amend his Complaint to be futile. (Ordered by Judge Matthew J. Kacsmaryk on 1/5/2021) (awc)
