This case was referred to United States Magistrate Judge Susan K. Lee pursuant to 28 U.S.C. § 636(b)(1) and Fed.R.Civ.P. 72(b) for a report and recommendation. Magistrate Judge Lee filed her report and recommendation on July 8, 2009. [Court Doc. No. 20]. The parties have not filed any timely objections. After reviewing the record, the Court ACCEPTS and ADOPTS the report and recommendation pursuant to 28 U.S.C. § 636(b)(1) and Fed.R.Civ.P. 72(b).
