More specifically, the Court DENIES the motion as to Coun ts I and II, but it GRANTS the motion as to Counts III, IV, and V. Counts III, IV, and V are dismissed. As to Count VI, the Court GRANTS EQM's motion as to C.J. Hughes' claims for interest pursuant to CASPA, but it DENIES the motion as to C.J. Hughes' claims for a penalty and attorney fees.
