IT IS FURTHER ORDERED that Count I of plaintiff s Amended Complaint is dismissed for failure to state a claim upon which relief can be granted. IT IS FURTHER ORDERED that Counts II through VII of Plaintiff s Amended Complaint are dismissed for lack of subject matter jurisdiction.
