Court Description: ORDER denying 39 Motion to Compel; denying 30 Motion to Appoint Counsel. The Court finds that there is good cause to extend the time in which plaintiff may serve defendant Hughes an additional 90 days. The Court requests that the New York State Attorney General's Office work with DOCCS to ascertain Hughes address for purposes of serving him with the complaint in this action. By November 2, 2017, the Attorney General shall provide Hughes' address to the Pro Se Office, 100 State S treet, Rochester, NY 14614. Once this information is received, the Clerks Office shall issue amended summonses and cause the Marshal to re-serve the summons and complaint upon Hughes. The Marshal is further directed to report directly to the Court as to the status of service upon Hughes within ninety days of the filing of this order. Signed by Hon. Jonathan W.
