Court Description: ORDER granting in part and denying in part 39 Motion for Summary Judgment. For the foregoing reasons: (1) defendants' motion for summary judgment is GRANTED IN PART and plaintiffs false arrest claim is dismissed; (2) defendants' motio n for summary judgment is DENIED as to plaintiffs claim for excessive force; and (3) plaintiffs cross-motion for partial summary judgment is DENIED. The Clerk of the Court is respectfully directed to terminate the pending motion (Dkt. #39). The Court has scheduled a Pretrial Conference on September 9, 2022 at 11:00 a.m. in Courtroom 420.
