Court Description: ORDER GRANTING PRELIMINARY APPROVAL OF CLASS SETTLEMENT AND CONDITIONALLY CERTIFYING SETTLEMENT CLASS granting 72 Motion to Certify Class; granting 72 Motion to Approve; granting 72 Motion to Appoint Counsel. Based upon the foregoing, IT IS HEREBY ORDERED: 1. Preliminary Approval of Proposed Settlement. The Settlement Agreement, including all exhibits thereto, is preliminarily approved as fair, reasonable and adequate and within the range of possible approval. The Court finds that: (a) the Settlement Agreement resulted from extensive arm's length negotiations; and (b) the Settlement Agreement is sufficient to warrant notice thereof to Settlement Class Members and a full hearing on the approval of the Settlement. 2. Class Cert ification for Settlement Purposes. The Court conditionally certifies, for settlement purposes only, the following Settlement Class under Federal Rule of Civil Procedure 23(a) and (b)(3), as further set forth. 3. Class Counsel. The Court appoints Bro mberg Law Office, P.C., and the Law Office of Harley J. Schnall, as counsel for the Settlement Class. The Court finds that these counsel are competent and capable of exercising their responsibilities as Class Counsel. 4. Settlement Hearing. A final approval hearing (the "Settlement Hearing") shall be held before the Honorable Vincent L. Briccetti, Courtroom 620, The Hon. Charles L. Brieant Jr. Federal Building and United States Courthouse, 300 Quarropas Street, White Plains, New York 10601, on 4/24/2020 at 11:00 am as set forth in the notice to the Settlement Class. 11. Stay of Proceedings. All proceedings in the action are stayed until further order of the Court, except as may be necessary to implement the terms of the settl ement. Pending final determination of whether the settlement should be approved, neither the Class Representative nor any Settlement Class Member, either directly or in any representative or other capacity, shall commence or prosecute against any of the Released Parties any action or proceeding in any court or tribunal asserting any of the Released Claims.
