Bentivegna, Jeffrey Benaim. Defendants' motion to dismiss Plaintiff& #039;s Complaint is hereby GRANTED in part and DENIED in part. The claims against the Medical Defendants are dismissed with prejudice. Only the Eighth Amendment claim for excessive force against the Defendant Officers remains, and they are thus di rected to answer the Amended Complaint on or before April 20, 2018. In light of the fact that Plaintiff is incarcerated, the Court hereby waives the Initial Pretrial Conference and directs the parties to confer, complete, and submit the attached case management plan on or before May 4, 2018.
