For clarity, all claims remain as to the City Defendants who did not move to dismiss. Within fourteen days of this order, should Plaintiff wish to seek leave to replead consistent with this opinion, he may file a red-lined version of the proposed Third Amended Complaint, showing changes from the Complaint, together with a letter application, not to exceed three pages, expla ining how the proposed amended pleading cures the deficiencies identified above. The Clerk of Court is respectfully directed to close the motion at Dkt. No. 29.
