Court Description: OPINION & ORDER: re: 16 MOTION to Dismiss the Complaint. filed by Del Gatto Inc. For the foregoing reasons, the Court denies the motion to dismiss the Complaint's breach of contract claim, but grants the motion to dismiss Polk 's GBL and unjust enrichment claims. The Clerk of Court is respectfully directed to terminate the motion pending at docket 16. Counsel are further directed to prepare a Civil Case Management Plan and joint letter in accordance with the Court� 39;s Individual Rules, to be submitted to the Court no later than July 27, 2021, at noon. The plan should provide the completion of fact discovery by the end of October 2021. In formulating the case management plan, counsel should discuss whether, particularly as informed by the discussion herein, there are terms on which this matter can be resolved.
