The only reason that is case was allowed to go forward on a limited basis following the motion to dismiss was because this court was required to draw all re asonable inferences from the CAC in Plaintiffs favor. Following discovery, Plaintiff has not in the end produced the required evidence to support its allegations made in its CAC. Defendants' motion for summary judgment is GRANTED. Plaintiffs mot ion for summary judgment is DENIED. The Clerk of Court is respectfully directed to remove Dkt. Nos. 326, 334, 345, 346, 347, and 351 from this court's list of open motions and to close the file..
