For the foregoing reasons, Defendant Harvey Weinstein's motion to dismiss is denied, and Defendant Robert Weinstein's motion to dismiss is granted. Plaintiffs claims for sexual battery, gender violence, batte ry, assault, sex trafficking, negligence, and negligent retention or supervision will proceed against Harvey Weinstein, The Weinstein Company LLC, and The Weinstein Company Holdings LLC.
