For the foregoing reasons, Gansert's motion to strike Miello's affirmative set-off defense is granted. The Court res pectfully directs the Clerk of Court to terminate the motion pending at docket entry 25. This matter will now proceed expeditiously to discovery. The Court directs counsel to jointly prepare a Civil Case Management Plan and Scheduling Order in acc ordance with the Court's Individual Rules, available at http://www.nysd.uscourts.gov/judge/Engelmayer, to be submitted to the Court no later than May 8, 2019.
