Court Description: OPINION & ORDER: In light of the foregoing discussion, the ALJ failed to apply the correct legal standards and rendered a determination that was not grounded in substantial evidence. Thus, the Court cannot uphold the ALI's determination. In determining the final disposition of this matter, the most equitable judgment must be implemented. The Court has authority to reverse with or without remand. 42 U.S.C. § 405(g). "Upon a finding that an administrative record is incomplet e or that an ALJ has applied an improper legal standard, we generally... remand the matter to the Commissioner for further consideration." Curry v. Apfel. 209 F.3d 117, 124 (2d Cir. 2000) (citation omitted). Accordingly, because the ALJ faile d to adequately develop the record in reaching a determination of Plaintiff's residual functional capacity, the case should be remanded to the Commissioner to further develop the record. Wherefore, it is hereby ORDERED that the Commissioner&# 039;s decision denying disability benefits is REVERSED and this matter is REMANDED to the Commissioner pursuant to Sentence Four of 42 U.S.C. § 405(g), for further proceedings consistent with the above; and it is further ORDERED, that the Clerk of the Court serve a copy of this Memorandum-Decision and Order upon the parties to this action.
