Wallert v. Atlan et al, No. 1:2014cv04099 - Document 166 (S.D.N.Y. 2015)

Court Description: OPINION & ORDER: For the foregoing reasons, the Court grants the Universal defendants' and Hoffman's motions to dismiss and denies Wallert's motion for leave to take jurisdictional discovery. As to Wallert's copyright claims b rought under United States law, the dismissal is without prejudice to bring a future lawsuit, insofar as it is conceivable that Wallert may one day acquire standing to bring such claims (e.g., upon the dissolution of Moonstruck). As to Wallert 9;s copyright claims brought under foreign law, the dismissal is without prejudice to Wallert's right to bring such claims in a foreign forum. As to Wallert's state-law claims, the dismissal is with prejudice. The Clerk of Court is directed to terminate the motions pending at docket numbers 99, 124, and 143, and to dismiss the Universal defendants and Hoffman from this case. (As further set forth in this Order) Universal Music Group Inc., Universal Music MGB Songs, Univers al Music Publishing, Universal Music Publishing MGB France, Universal Music Publishing MGB France SAS, Universal Music Publishing, Inc., UMG Recordings, Inc. and Universal International Music B.V. terminated. (Signed by Judge Paul A. Engelmayer on 10/26/2015) (kl)
