Court Description: OPINION AND ORDER re: 9 MOTION to Dismiss the Complaint filed by Henry Saunders, Barbara Pankoski, ACP Consulting LLC. 28 U.S.C. § 1406(a) provides that "[t]he district court of a district in which is filed a case laying venue in t he wrong division or district shall dismiss, or if it be in the interest of justice, transfer such case to any district or division in which it could have been brought." However, no party has requested a transfer to another district. The Court grants defendants' motion and dismisses this action without prejudice to its being filed in a district where venue is proper.
