Court Description: OPINION re: 159 MOTION for Judgment as a Matter of Law; MOTION for New Trial: For the reasons set forth above, Connolly's motion for judgment as a matter of law is GRANTED in part and DENIED in part. The award of $25,000 for fu neral and burial expenses is reduced to $11,991.95 and the award of $10 million in punitive damages is vacated. Connolly's motions for a new trial and remittitur are DENIED. Judgment will be entered in favor of Mrs. Collado against Con nolly and the City in the amount of $4,311,991.95. Counsel for Mrs. Collado shall submit a proposed judgment on notice within ten days hereof. The parties shall discuss the issue of attorneys' fees and costs. If they are unable to agree on an appropriate award of attorneys' fees and costs, Mrs. Collado shall move for attorneys' fees and costs within thirty days hereof; Connolly and the City shall oppose the motion within fourteen days thereafter; and Mrs. Collado shall submit reply papers within seven days thereafter.
