Hahn v. Commissioner of Social Security, No. 1:2008cv04261 - Document 11 (S.D.N.Y. 2009)

Court Description: OPINION AND ORDER:#97561 Plaintiffs hearing loss is sufficiently severe to disable him from continuing with his rewarding, specialized work as an audio engineer. However, disability benefits under the Act are available only to those who are unable to perform any substantial gainful activity. For the foregoing reasons, the Commissioner's decision that neither plaintiffs hearing loss nor any of his other medical conditions render him disabled within the meaning of the Act is supported by substantial evidence. The Commissioner's motion for judgment on the pleadings is therefore granted. (Signed by Judge Gerard E. Lynch on 5/27/2009) (jfe) Modified on 5/29/2009 (jab).
