Court Description: OPINION AND ORDER re:#98036 42 MOTION for Summary Judgment by Intervention-Plaintiff, Barbara Mason filed by Barbara Mason. For the reasons stated above, the Court finds that Defendants have failed to raise a genuine issue of material fact with re spect to Mason's ownership of the copyright to the Composition. Accordingly, the Court grants Mason's motion for summary judgment and declares that Mason is the owner of the copyright in the Composition subject to the terms of the Purchase Agreement. The Clerk of Court is directed to terminate the motion documented as docket number 42. The Parties are hereby instructed to appear before this Court for a conference on September 22, 2009 at 2:30 p.m. at Courtroom 17C at 500 Pearl Street, New York, New York, 10007. SO ORDERED.
