Court Description: ORDER ADOPTING REPORT AND RECOMMENDATIONS : For the foregoing reasons, the Court adopts the findings and recommendations contained in the well-reasoned and thorough R&R, and grants the motions to dismiss (ECF Nos. 25, 37) in heir entirety. Accordingl y, the first amended complaint (ECF No. 10) is dismissed without prejudice, except for plaintiffs claims based on the Brooklyn Incidents, which are dismissed with prejudice. The Court grants plaintiff leave to submit a second amended complaint in acc ordance with the specifications set forth in the R&R and summarized infra. Plaintiffs second amended complaint must be filed within 45 days from the date of this Order. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be taken in good faith, and, therefore, in forma pauperis status is denied for the purpose of any appeal.
