Court Description: MEMORANDUM AND OPINION, Judgment is hereby directed to be entered against Amboy National Bank and George E. Scharpf, jointly and severally, in favor of the pltffs in the sum of $777,400. Judgment is directed to be entered against Amboy National Bank and George E. Scharpf, jointly and severally, in favor of the pltffs in the sum of $419,512.05, as and for counsel fees and disbursements; and for the add'l sum of $27,532.80, as and for costs and expenses, for a total sum of  6;447,044.85. Judgment in the sum of $32,079 is directed to be entered against Amboy National Bank and George E. Scharpf, jointly and severally, in favor of the pltffs for the benefit of Receiver's Counsel. The total judgment to be awarded against the defts Amboy National Bank and George E. Scharpf, jointly and severally, is $1,256,523.85. The Clerk of the Court is directed to transfer the proceeds of the Public Auction Sale that were deposited with him, together with such interes t that has accrued, to the pltffs. The motion of the Receiver for an Order approving and settling his second and final account is granted. His request for compensation for the period December 1st, 2004 through July 15th, 2007 is granted in the sum of $5,000. In an Order dated March 2, 2009, reported in 358 F. Supp.2d 176, I granted the Receiver's motion for interim compensation in the sum of $61,484.45, which has not been paid, and approved his first intermediate account. The Rece iver is, therefore, awarded the total sum of $66,484.45 to be paid by the pltffs. The Receiver is hereby directed to transfer any monies remaining in his account to the pltffs c/o Todtman Nachamie Spin & Johns, Attorneys for pltffs, 425 Park Ave nue, New York, NY 10022, and is thereafter discharged. The Receiver's Counsel is awarded the sum of $68,672.47, representing fees and disbursements for services rendered and payable by the plaintiffs.
