Defendant denies Plaintiff’s allegation and contends that Plaintiff’s fall was the result of her 7 8 own actions and not the result of any negligence on the part of Defendant. 9 In the alternative, Defendant further contends that if it was negligent, Plaintiff was also 10 negligent and that Plaintiff’s negligence exceeds the alleged negligence of Defendant and/or that 11 Defendant is entitled to an offset on damages for any negligence attributed to Plaintiff. Defendant further contends that the injuries claimed by Plaintiff were not proximately caused by 12 13 the incident at Smith’s and that Plaintiff failed to mitigate her damages. 14 II. 15 STATEMENT OF JURISDICTION This Court has jurisdiction pursuant to 28 U.S.C. 1332 because diversity of citizenship exists 16 17 between the parties and the amount in controversy exceeds $75,000.00. 18 III. 19 FACTS ADMITTED BY THE PARTIES AND REQUIRE NO PROOF 20 1.
