Hamilton in Cause No. 4:10-CV-1191-JCH, IT IS HEREBY ORDERED that plaintiff's claims against defendant CMS are SEVERED from the instant action, because they are no t properly joined under Rule 20(a)(2) of the Federal Rules of Civil Procedure. The Clerk of Court is instructed to open a new case, utilizing the complaint submitted here. Pursuant to the Court's Order, only the claims against defendant CMS will be inlcuded in this action.
